User Agreement

▷ Please read these Terms of Service (“TOS”) before commissioning artwork or rigging from us. By accepting a commission, you confirm that you have read and accepted these terms.If you have questions about a commission or these TOS, please contact us by email or DM.

General

▷ You must be 18 years or older to commission from us.▷ We may accept or decline a commission at our discretion.▷ A commission is only considered accepted once we have confirmed the project details and agreed to take it on.▷ Commission requests can be submitted by email, contact form, or social media DM.▷ A place in the queue is not guaranteed until we have confirmed your commission.▷ We may refuse future commissions in cases of harassment, repeated non-payment, fraud, abuse of our work, or other serious violations of these TOS.

Prices

▷ Prices are based on the complexity of the requested work.▷ Listed prices are estimates and may increase if a design requires significantly more work than the listed tier covers.▷ We will provide you with the final price before starting the commission.▷ Once a price has been agreed upon for a commission, we will not change it without discussing the change with you.▷ Our prices are stated in EUR.▷ Unless otherwise stated, prices are subject to the applicable German VAT rules. If we qualify for the German small-business VAT exemption under §19 UStG, VAT will not be charged.▷ Harassment or abusive behavior regarding our prices may result in us declining future commissions.

Payment

▷ We currently accept:
- PayPal Invoice
- SumUp
- StripePayment is normally required upfront before we begin work.▷ For Art + Rigging packages, payment may be split between the two parts. Each part must be paid before work on that part begins.▷ Unless otherwise agreed, invoices must be paid within 14 days.▷ If payment is not received within this period, we may cancel the commission and release your place in the queue.▷ If you repeatedly commission work and fail to pay, we may refuse future commissions.▷ If you use another person's payment account, you confirm that you have permission to use that account for the transaction.▷ All commissions are digital products/services. Nothing will be physically shipped unless specifically agreed otherwise.

Installment Option

▷ Installment payments may be available to repeat or trusted customers for orders over €200.▷ Installments must be agreed upon with us before work begins.▷ Unless otherwise agreed, commercial and usage rights to the completed work are granted only after the full commission price has been paid.

Cancellations, Refunds & Withdrawal Rights

▷ Because commissions are custom-made, cancellation and refund options depend on the stage of the project and applicable law.▷ If we have not started work, you may request cancellation. Any refund will be handled according to the payment and cancellation agreement.▷ Once work has started, refunds are generally not available for simply changing your mind or no longer wanting the commission.▷ If we cancel a project ourselves, we will refund the appropriate amount based on the work that has already been completed, unless another solution is agreed.▷ Nothing in these TOS removes any mandatory statutory consumer rights.▷ For digital content/services, any applicable statutory withdrawal rights will be handled in accordance with German law. Where legally permitted, we may request your express consent to begin work before the withdrawal period ends and your acknowledgement of the consequences of that consent.

Chargebacks & Payment Disputes

▷ If you have a problem with a payment or commission, please contact us first so that we can try to resolve the issue.▷ You must not knowingly submit a false, fraudulent, or unauthorized chargeback.▷ If a payment dispute or chargeback is opened, we reserve the right to provide the relevant transaction and commission records to the payment provider.▷ This does not affect any mandatory statutory rights you may have.

What We Will and Will Not Create

* Some BDSM themes are also outside our comfort zone, including ageplay, diapers, scat, urine, fecal matter/discharge, feet, pregnancy kinks, and unrealistic inflation.If you are unsure whether we will accept a request, please ask before commissioning.

Vtuber Art Process

▷ We will provide progress updates, normally through Discord or email.
For artwork, the process generally consists of:1. Sketch
2. Lineart
3. Flats
4. Shading
5. Final PSD/review

▷ You may request up to 5 rounds of sketch revisions. Additional revisions may be charged depending on the amount of work required.
▷ Once the sketch has been approved, major design changes may require an additional fee.▷ If we made an error or omitted something that was clearly included in the agreed commission, reasonable corrections will be made without an additional fee.▷ After the model is completed, you will receive a PSD for review.▷ You will have 14 days to provide your revision list.▷ After revisions are implemented, you will receive another version for review and may provide another revision list within the applicable review period.▷ If you do not provide feedback within the stated review period, we may consider the commission completed. Later revisions may be subject to an additional fee.▷ We are not responsible for dissatisfaction caused by requested changes that were not communicated during the revision process.▷ We will not be required to make unreasonable stylistic changes or changes that were not part of the original commission.

Rigging Process

▷ We will provide progress updates, normally through Discord or email.▷ Once the rigging is initially completed, you will receive the exported model for testing.▷ A configured VTube Studio settings file will also be provided where applicable.▷ You will have 30 days to provide your revision list.▷ Revisions must generally be minor adjustments to the agreed rig. Major changes to the artwork or fundamentally changing the agreed rigging scope may require an additional fee.▷ After revisions are completed, you will receive another version for review.▷ If you do not provide feedback within the applicable review period, we may consider the commission completed. Later revisions may be subject to an additional fee.▷ We will not be required to make unreasonable changes that were not part of the original commission.

Rigging Requirements

▷ We generally do not rig models that have already been rigged by another rigger.▷ Exceptions may be considered if we receive written permission from the original artist/rigger.▷ For rig-only commissions, you must provide a properly cut and rig-ready model.▷ We can provide advice about model cutting, but we currently do not provide model-cutting services.▷ If possible, we may communicate directly with your artist to ensure the best result. We can communicate in English and German.▷ We do not provide the .cmo3 project file by default. It may be available for an additional fee, generally around 2× the base rigging price, depending on the project.

Additional Work

▷ Requests for new features, additions, or changes after completion can be discussed separately.▷ Current commissions will normally receive priority over additional work on previously completed models.▷ Additional work may require a new quote and place in the queue.

Additional Work

▷ We will provide an estimated timeline when your commission is accepted.▷ The current queue may be displayed on our public commission board.▷ Estimated working times are:Model Art: approximately 6–8 months
Rig Only: approximately 1–4 months
Model + Rig: approximately 6–8 monthsThese are estimates, not guaranteed delivery dates.Actual completion time depends on the complexity of the project, revisions, design work, queue position, and our availability.▷ If you provide a realistic deadline before accepting the commission and we agree to it, we will do our best to meet that deadline.▷ If you have not provided a deadline, please avoid repeatedly requesting status updates. We will contact you if there is an important change to the expected timeline.▷ If we expect a significant delay, we will inform you and discuss possible solutions.

Finished Files

▷ Finished files will normally be delivered through Google Drive, email, or another agreed digital delivery method.▷ You are responsible for downloading and safely storing your files.▷ We may keep backups, but we cannot guarantee that files will be available indefinitely.▷ Please keep your own backup copies.

Copyright, Portfolio & Credits

▷ Unless otherwise agreed in writing, we retain the copyright and ownership of the artwork & rig we create. Purchasing a commission does not automatically transfer copyright to you.▷ We may display completed work, WIPs, screenshots, videos, and parts of the commission in our portfolio, website, social media, or other promotional material.▷ We may also stream the creation process on platforms such as Twitch or YouTube.▷ If you require the commission to remain private, please tell us before work begins. Confidential/NDA commissions may require an additional fee.▷ Unused WIPs may be reused for personal or promotional purposes where appropriate.▷ We reserve the right to sign or watermark examples of our work when displaying them publicly.▷ You will receive appropriate credit for your character/design, and we will credit the original artist when applicable.

Your Usage Rights

▷ Once the commission has been fully paid, you receive the agreed rights to use the finished work commercially for your own purposes.Commercial use may include:- Monetized streams
- Monetized videos
- Music releases
-Merchandise
- Other agreed commercial uses▷ These rights are personal to you and may not be transferred or resold to another person without our written permission.▷ You may not:- Claim our work as your own.
- Remove our credit where technically possible.
- Modify or substantially edit our work without permission.
- Resell the artwork or rig itself as a standalone product.
- Use our work for NFTs or cryptocurrency-related projects.
- Use our work for AI/ML training, datasets, or similar purposes.
- Use our work for other purposes that were not included in the agreed usage rights.▷ You are responsible for protecting your own rights to the character and character design.

Copyrighted Characters

We generally do not accept commissions involving copyrighted characters that we do not have permission to work with.If you believe you have the necessary rights or permission, please discuss this with us before commissioning.

Corporate & Agency Work

If the model is being commissioned for a company, talent agency, or other commercial organization, pricing may be adjusted based on the intended use, scale, audience, and commercial value of the project.Corporate commissions may therefore receive a separate quote.

Privacy & Confidentiality

▷ We will generally keep private conversations and commission information confidential.▷ We may disclose information when necessary to process payments, complete the commission, comply with legal obligations, prevent fraud/abuse, or protect our legal rights.▷ Commission-related personal data will be processed for purposes such as:- Processing and delivering your commission
- Communication with you
- Payment processing
- Accounting and tax obligations
- Legal compliance▷ Further information about how personal data is processed can be found in our separatePrivacy Policy

Liability

We remain responsible for liability that cannot legally be excluded or limited.To the extent legally permitted, we are not responsible for problems caused by circumstances outside our reasonable control, including customer-provided files, third-party software, platform changes, computer failures, or loss of files after delivery when the customer has failed to keep a backup.Nothing in these TOS limits mandatory statutory rights.

Changes to These TOS

We may update these TOS from time to time.The version applicable to a commission is generally the version accepted when that commission is agreed, unless a later change is required by law or mutually agreed upon.

Severability

If any part of these TOS is found to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

Applicable Law & Jurisdiction

German law applies to these TOS, subject to mandatory consumer protection laws that apply to consumers in their country of residence.For business customers, the legally permissible place of jurisdiction may be agreed separately.

By accepting a commission, you confirm that you have had the opportunity to read these Terms of Service and agree to them.

User Agreement

You must provide clear visual references for the character.▷ If the character is not finalized and we have to create or significantly design the character ourselves, the commission will be treated as a character design commission and may have a different price.▷ Please make sure you are familiar with our usual art style before commissioning us.

Artistic Freedom

▷ You are commissioning us to create artwork in our own artistic style and creative interpretation.We may make artistic decisions regarding things such as:- Hair
- Clothing
- Poses
- Facial expressions
- Details
- Colors
- Composition
- Other stylistic elementsThe finished artwork will therefore not necessarily be an exact copy of your references.▷ When commissioning artwork of another person's OC, VTuber, character, or other intellectual property, you must have that person's permission to do so, unless they have publicly stated that commissions of their character are allowed.

Prices

Turn-over Times & Deadlines

Chargebacks & Payment Disputes

▷ For Art, we work in stages: Sketch, Lineart, Flats then Shading. After each Stage, you will get a WIP to review.▷ WIPS will be provided every Weekend via Discord or E-Mail after starting your commission.▷ We will always provide a inital WIP sketch, occasionally with some pose ideas, that we initially make before we start the Lineart and send it to the Client. This is to check that there are no mistakes and the Client likes the pose etc.The Client can ask us to do changes at this stage. The Client can ask us to adjust this sketch 3 times maximum.Sketch Commissions are not affected by this rule and can’t be changed.▷ You will have two weeks to write a list with revisions for us to review and discuss.* If the deadline passes without feedback, we assume you are happy with the sketch and will continue on the project.▷ Fees will apply if changes are made to the Commission after the Sketch Stage. The Fee will depend on the nature of the change.▷ If missing or inaccurate elements are our fault (e.g. Details in the Order have been overlooked) then minor changes are allowed even after the order is complete.▷ We ask the Client not to post the WIP image(s) to social media or anywhere else! The Client must ask first if they wish to do so. However, please respect our wishes, if we decide to decline.▷ We will check in with the Client one last time before we start to paint/shade, to make sure the colors are correct. After this is approved, we will continue to move on to finish the commission.▷ In the absence of feedback, we are not responsible if you are unsatisfied with the finished product.* All revisions will be discussed with us and implemented when reasonable. We won't implement unreasonable changes if they aren't intended, such as stylistic changes.

What We Will and Will Not Draw

Commission Queue & Completion Times

▷ We currently do not accept guaranteed deadlines for artwork commissions.Estimated completion times depend on:- Current workload
- Queue position
- Complexity of the artwork
- Number of revisions
- Design work required
- Our other work and personal obligations
- Unexpected circumstances▷ For fully colored artwork, the estimated waiting time can range from approximately 1 month to up to a year, depending on the circumstances.These are estimates only and are not guaranteed delivery dates.▷ We may not always work strictly in queue order. Simpler commissions may be completed before more complex commissions even if they were ordered later.▷ We will provide an estimated timeframe when we start your commission.▷ Our commission queue may be available through our public Trello board.▷ We balance commissions with our regular jobs, personal projects, and other responsibilities. We intentionally limit our workload to avoid burnout and maintain the quality of our work.▷ Please be patient with the process. Quality artwork takes time.

Work in Progress & Revisions

Artwork is generally created in stages:- Sketch
- Lineart
- Flats
- Shading/final renderingWIPs may be provided through Discord or email, normally around weekends.

Sketch Stage

▷ We will provide an initial sketch, sometimes including pose ideas, before proceeding to lineart.▷ You may request up to 3 changes to the initial sketch.▷ You will have 14 days to provide your revision list.▷ If you do not provide feedback within this period, we may assume that the sketch has been approved and continue working.▷ Sketch-only commissions are not covered by the standard sketch revision process and cannot be changed, as these are "Surprise Me" Commissions.

After Sketch Approval

▷ Once the sketch has been approved, significant changes to the character, pose, composition, outfit, or design may require an additional fee.▷ If we made an error or missed something that was clearly included in the agreed commission, reasonable corrections will be made without an additional charge.▷ We will check with you before the final painting/shading stage to confirm that the colors are correct.▷ Once colors are approved, further color or design changes may be subject to an additional fee.▷ All revisions must be discussed with us and must be reasonable and related to the agreed commission.▷ We are not required to make changes that would fundamentally alter our artistic style or the agreed concept.

WIP Privacy

▷ WIP images are provided for your personal review.▷ Please do not publicly post or distribute WIP images without asking us first.▷ We may decline permission to post WIPs before the artwork is completed.

Finished Artwork

▷ The finished artwork will normally be delivered through:- Google Drive
- Email
- Or Another agreed digital delivery method▷ You will normally receive a high-quality PNG or JPEG.▷ We do not provide raw working files, source files, layered files, or other internal working data unless specifically agreed upon.▷ You are responsible for downloading and safely storing your finished files.▷ Although we may keep backups, we cannot guarantee that your files will be available indefinitely in the event of hardware failure, accidental deletion, data loss, or other technical problems.

Copyright, Portfolio & Credits
