User Agreement

▷ Please read this entirely and carefully. We will refuse your commission if you do not agree to these terms.▷ By purchasing our services (Rigging and/or Art), you automatically agree to the following Terms & Conditions.▷ Violations of these Terms of Use will result in you being added to our blacklist indefinitely and without warning.▷If you have any questions about commissions or this TOS, feel free to send us a email or DM Void on social media!

General

▷ Clients MUST be 18 years or older to commission art from us.
You automatically agree that you are over 18 when you place an order with us.▷ Commissions are not based on first-come-first-serve, we have the right to decline any commission without revealing the reason.▷ We have the right to not disclose our inner operation and commission selection criteria.▷ Commission Applications will be taken via E-Mail, Contact Form or DM on Social Media.▷ Individual slots will not be taken until we have confirmed details with the client and have decided to take on the project.

Prices

▷ We reserve the right to charge more if we deem fit, depending on the complexity of your request.▷ Our Prices are subject to change and can be reduced or raised at any time without explanation if we wish.▷ Please keep in mind, Tier Prices are estimates, if you have a complex design you will receive a higher quote.▷ The stated prices do not include the statutory sales tax or other price components, as we are exempt from sales tax according to §19 UStG of german law.▷ Harassment due to our prices or haggling will get you a place on the blacklist.

Payment

▷ Payment is Euro only.▷ Payment can only be done via PayPal Invoice or Stripe. Once details are confirmed and the commission is ready to be accepted, we will send an invoice. The client then has 14 Days to pay. This applies to the downpayment, as well as the main payment.▷ If Payment is not received within the 14 days the order will be canceled and we will terminate your slot.▷ All Payments must be made upfront, as soon as we start working on the project. However, if you commission Art & Rig Packages, the Payment can be split up by part (First Art, then Rigging) but must be paid upfront before we begin to work on the specific part of the project.▷ For Repeat Customers we allow an option for orders over 400 € to pay 50% when starting the commission and pay the rest after completion.▷ We are not responsible for any mistakes that are made on your part over the course of the transaction.▷ If you happen to use a guardian PayPal account, please note that you hereby acknowledge that you have their permission to take part in this transaction.▷ Repeated counts of commissioning a project and failing to pay will result in blacklisting.

PAYPAL / Stripe DISCLAIMER

▷ Please note that all of our sales are considered “Digital Goods” and it is the Artwork’s "Intellectual Property" that is purchased by you, the Client.▷ Nothing is ever intended by either us or the Client, to be physically shipped.

Refunds

▷ We do not issue refunds after the commissions is completed▷ We can only refund 100% (excluding the downpayment) of the payment if we have not started working on the Commission.▷ Once a commission has been started, we do not offer refunds for any reason.▷ However, if we cancel a project from our side, we will reimburse the lost fees and refund the client according to the amount of work that was completed at the time of cancelation.▷ Every Commission is a Custom Order, so the right of cancellation according to § 312g Abs. 2 BGB (German Law) is void for goods that are not prefabricated and when the item, in this case, the Commission, is manufactured/made specifically for the individual (custom orders). As such your Commission can not be returned or refunded after starting and/or completing the commission.

CHARGEBACKS

▷ You are NOT authorized to issue a chargeback for any reason.▷ If for any reason your PayPal account malfunctions or authorizes a refund request without your knowledge, you must contact us as soon as possible in order to resolve the issue.▷ You are required to contact us when you need to cancel a commission request. Please keep in mind that this is only possible if we have not started working on your commission.▷ Purposefully issuing a chargeback without contacting us to cancel/refund a project will result in immediate blacklisting for you as well as your email address, and anyone sharing your PayPal account, including side accounts.

Vtuber Art Specific Info

* There are some BDSM Topics we do not feel comfy with, like Ageplay, Diapers, Scat, Pee, anything to do with fecal matter or discharge, feet, pregnancy kinks and unrealistic inflation. If you are unsure if we will do your request just ask.

▷ We will keep you updated on progress throughout the project and send you watermarked images. This usually happens on weekends.

Rig Specific Info

* There are some BDSM Topics we do not feel comfy with, like Ageplay, Diapers, Scat, Pee, anything to do with fecal matter or discharge, feet, pregnancy kinks and unrealistic inflation. If you are unsure if we will do your request just ask.

▷ We will not rig a previously rigged Model. In rare exceptions written permission from the original rigger and artist is required.▷ We will send you updates on progress throughout the project, with videos or gifs attached.▷ After initial completion, we will send the rigged model to you for testing along with a fully configured settings file for VTube Studio. If fixes or adjustments are needed, they will be done ASAP.▷ We do not send out the cmo3 project file. This would require an extra fee and is usually 2x the base price.In the case (of course, if your permission is granted/given) to live stream on working on your commission, there is a possibility that the movement of your model will be tested with a tracking software live on stream.▷ If you would like additions or new things added to your model at a later time, we can discuss scheduling then. We will prioritize any current commission we are working on over any adjustments or additions for past models.▷ If you commission Rig Only you will have to provide a fully cut Model drawing for v0id to rig it.▷ We can give cutting advice if the art is not made by us but we do not offer cutting services at the time.▷ Please note that it would be beneficial for us to be able to have contact with your Artist directly to ensure the best outcome of the commission. So if possible please help us establish contact with your Artist. We are able to communicate in two languages with them. (English, German).

Process of a Commission

▷ The commission request is made via E-Mail, Contact Form or DM on Social Media.▷ Please give us as much information as possible so that we can make you an offer.

QUEUE & ORDER START

▷ We will provide a rough timeline to all clients that have been picked.▷ As long as your commission hasn't started you have a place in the queue.▷ Projects will be worked on according to the queue.▷ Shortly before we can start your commission we will invoice you regarding the payment.▷ As soon as Payment is received we will start to work the commission.

Turn-over Times

• Model Art: 2 - 6 Months from the point of starting, depending on complexity and if design work is needed or not.
• Rig Only: 1 - 6 Months from the point of starting, heavily depending on complexity
• Model & Rig: 3 - 8 Months from the point of starting, depending on complexity and if design work is needed or not.Please keep in mind these are all estimates.We will always give you an estimate when we start.We understand that our wait times are long, but please be aware that currently, Sassy works a 25-30-hour Job and v0id works a 40-hour Job during the week, on top of doing commissions. - As well as personal projects. So we space out work time to avoid burnout and/or overworking ourselves. Because of this Turn-over Time can vary heavily due to the complexity of a project. In the end, our Main Focus is delivering Quality and Quality takes some time, when organized with our other obligations. We hope you can understand this.▷ If you give us a deadline for a debut date and it is in a realistic time span for us, you can be sure that we will finish the project if we accept.▷ If you did not alert us to a deadline, you must not send reminders. Reminders will be ignored.▷ We will always inform you in time if a Turn-Over Time can not be met, for whatever reason, and we will do our best to work with you on a solution.

Revisions Process for Vtuber Art

▷ WIPS will be provided every Weekend via Discord or E-Mail after starting your commission.▷ For Art, we work in stages: Sketch, Lineart, Flats then Shading. After each Stage, you will get a WIP to review.▷ You get to review the Sketch 5 times maximum before a fee applies.▷ Fees will apply if changes are made to the Model or Design after the Sketch Stage has been approved. The Fee will depend on the nature of the change.▷ If missing or inaccurate elements are our fault (e.g. Detail in the Order have been overlooked) then minor changes are allowed after the order is complete.▷ Upon completing the Model, a PSD will be sent to you for review. If you have ordered a Design you will receive a PNG. Please ensure that you are available to provide feedback during this time.▷ You will have two weeks to write a list with revisions for us to review and discuss.*▷ After at least a few days we will update you on how long it will take to implement your reviews. We will then send the file again.▷ You will then, again, have two weeks to write a list with revisions.
▷ This repeats until no more revisions are needed.▷ If you do not get back to us within two weeks' time, we will consider the commission as finished. If you miss the deadline but still have revisions a fee applies.▷ In the absence of feedback, we are not responsible if you are unsatisfied with the finished product.* All revisions will be discussed with us and implemented when reasonable. We won't implement unreasonable changes if they aren't intended, such as stylistic changes.

Please note that no major changes can be made to the art.*▷ After at least one week we will update you on your revisions given.▷ You then, again, have 30 days to create a list of small changes.▷ This repeats until no more revisions are needed.▷ If you do not get back to us within 30 days' time, we will consider the commission as finished. If you miss the deadline but still have revisions a fee applies.▷In the absence of feedback, we are not responsible if you are unsatisfied with the finished product.* All revisions will be discussed with us and implemented when reasonable. We won't implement unreasonable physics changes if they aren't intended, such as stylistic changes.

Finished Product

▷ As we constantly strive to improve, your Rigging or Model may differ from the samples in our Gallery, depending on the time passed when examples were posted.▷ The finished product will be sent via Goggle Drive Link or E-Mail Attachment.▷ You, the client, are responsible to save the provided files.▷ We can not guarantee that your file will be safe from computer breakdowns, accidental deletion or loss. Even if we do take great care to keep all our files backed up.▷ If you wish, you are allowed to give us Feedback via DM or Comment after completion.For Ready to Rig Model Art:▷ If you choose to get your model rigged by someone other than v0id: We are able to communicate with a rigger of your choice and make adjustments to the Art, if needed.▷ If you would like additions or new things added to your model at a later time, we can discuss scheduling then. We will prioritize any current commission we are working on over any adjustments or additions for past models.

Rights, Use and Credits

▷ We retain original copyright and ownership of the Work, including but not limited to redistribution, reproduction, promotion and display of the Work on our websites, social media and portfolios at our discretion. We have the right to reuse unused WIPs for future projects, personal or otherwise.▷ The process will likely be posted on Twitter and/or streamed on Twitch or YouTube unless you request otherwise before starting the project. A fee applies for an NDA or confidential order.▷ You, the customer, are granted exclusive rights to commercial use of the work created in accordance with the agreement, which may not be transferred to other parties.Commercial means: use in streams or other monetized works (i.e. including, but not limited to: merchandise, monetized videos, music releases, or more);Resale rights are included here and mean the sale of the work to another party or another platform.▷ You may not modify, edit or change the work at any time without our permission.▷ Any work performed or made available to you may not be used for AI (artificial intelligence, machine learning, AI/ML training, NFT, blockchain or any other for-profit platforms or purposes). Such use is completely prohibited and may result in legal action.▷ You may not pass off the work as your own or someone else's and must always credit us as the artist using our social tag/username/link (v0id / v0idmochi or SassyBlaze / SassyBlaze_Art).▷ Only you and/or we may publish the finished order. Unless otherwise agreed.▷ Under no circumstances are you permitted to use any portion of your commissioned art for non-fungible tokens (NFTs).It is also strictly prohibited to use our art for advertising or profit related to non-fungible tokens (NFTs) or cryptocurrencies.

Copyright for all Commissions

▷ We reserve the right to sign and/or watermark our own work when posted on our Websites and Social Media.▷ You are responsible for protecting your ownership over rights to a character design.▷ We retain all copyright over our work (Art and/or Rig), which includes the right to use the image as a sample for sales or self-promotion unless otherwise agreed upon.▷ We will however always give proper credit to you and the artist for ownership of the character’s design and Artwork rigged, if it is not from us.

Information for Corporate Work

If there are plans to use the model for business purposes (this applies to a company or a talent agency commission), the total price will be adjusted according to the scale of the project.

Severability Clause

If any provision of the present General Terms and Conditions is held to be unenforceable, the enforceability of all remaining provisions shall not be affected thereby.

Place of performance, place of jurisdiction

The parties agree that Hamburg, Germany is the place of jurisdiction and place of performance of their mutual rights and obligations from this contract.

Privacy Policy

Any chat with us shouldn’t be disclosed in public except as proof for any misconduct. Likewise, We will not disclose the chat unless a need arises.Collected data is used solely for the purpose of processing your commission and for the german tax reports.The Privacy Policy for Infomation that is collected via this Site can be read here:Privacy Policy

Product Limitation of Liability

Due to the nature of the products, no liability claims can be made against the seller.

Clients must have a visual reference sheet of their OC. We will decline the commission if the client does not have clear references and/or the character is not finalized.
Everything, where we have to design, is a character design commission.▷ We have the right to not disclose our inner operation and commission selection criteria.▷ Commission Applications will be taken via Request Form, E-Mail or Social Media DM.▷ Individual slots will not be taken until we have confirmed details with the client and have decided to take on the project.▷ Clients must read, understand and agree to the Terms and Services. If the client commissions us they automatically agree to our Terms of Service.▷ If there are any questions, regarding Commissions or this T.O.S., feel free to send us an E-Mail or DM us on social media!▷ Please be familiar with our usual content and art style.Artistic freedom and choices WILL be made - We will add stylistic choices to our art (example: How hair looks, outfits etc.). The Client is commissioning us for our perspective and creative judgment for the rendition of their character. The final product will not be the reference to a “T”. Please be aware of that.▷ When placing a Commission for/or displaying someone else, and/or their OCs/Vtubers/Other, the Client needs that person's written approval OR it must be available as public information that commissions from/for/with this person are okay with them.

Turn-over Times & Deadlines

▷ We currently do not accept deadlines on Art commissions. The time for the commission to be completed can vary due to health, queue order of commission, complexity, day job, and/or other varying factors.▷ For fully colored commissions, expect a wait time anywhere from two weeks to half a year, depending on my current workload.▷ We do not ALWAYS go in order when the commission was accepted due to the fact that some Clients order more simplistic illustrations. So even though there is a list, depending on what the Client gets, it will determine how long it takes. We do try my very best to go in order, but that does not always go as planned! The wait time is estimated and might take longer than usual due to life matters and or work blocks.▷ Because of Privacy Policies, we do not offer a public queue. Just ask us directly, please.

Work In Progress (WIP) + Changes

▷ We will always provide a WIP sketch, occasionally with some pose ideas, that we initially make before we start the Lineart and send it to the Client. This is to check that there are no mistakes and the Client likes the pose etc.The Client can ask us to do changes at this stage, if something is bothering them.The Client can ask us to adjust this sketch 3 times maximum.More changes will be charged.Sketch Commissions are not affected by this rule and can’t be changed.▷ We will check in with the Client one last time before we start to paint/shade, to make sure the colors are correct. After this is approved, we will continue to move on to finish the commission. We will not offer Progress previews after this step, as they halt though already slow work pace.▷ We ask the Client not to post the WIP image(s) to social media or anywhere else! The Client must ask first if they wish to do so. However, please respect my wishes, if we decide to decline.▷ Once the piece is complete we will not be doing big changes to it. If the Client however requests a change/add-on that they haven’t listed in their information:Depending on the change, we will charge the Client. This is not personal. In the future, the Client must make sure to send in all their information, even if it has to be every detail.

Receiving your finished Artwork

▷ As this is a digital Item the Client will not receive a physical version/print of their commission.▷ We do not send out the Raw Data of our works. The Client will receive a High-Quality PNG/JPEG.▷ When a commission is finished, the Client will receive a Google Drive or Dropbox download link for the High-Quality Version.▷ We delete the files on my Google or Dropbox Drive after a few days, so please download them directly. If the Client loses the file, contact us via E-Mail. However, we do not guarantee that we will still have the file if some time has already passed.

Rights, Usage & Credits

▷ We retain original copyright and ownership of the Work, which includes but may not be limited to redistributing, reproducing, advertising, and displaying the Work on my websites, social media, and portfolios according to my discretion. We have the right to repurpose unused process work for future projects, personal or otherwise.▷ The process will likely be posted i.e. on Twitter and/or streamed on Twitch or Youtube unless Clients request otherwise before the project begins. An NDA or confidential commission status may be subject to a fee.▷ Clients are granted exclusive rights for personal use of the Work produced as agreed upon, which must not be transferred to any other parties.Personal use includes:
Social media profile pictures, personal/private wallpaper, personal website display (with credit) and use for a social media posts (with credit).If the Client wishes to print the Artwork for themself only, please ask us.▷ Unless specified in the commission information or otherwise discussed and agreed upon, commercial licenses and reselling rights are not included. Commercial means usage on streams, broadcast content, or any monetized work (i.e. including but not exclusive to: merchandise, monetized videos, music releases); and reselling rights means selling the Work to another party or another platform or on any platform.▷ Commercial Use can be discussed. If the Client would like the sole ownership/licensing and full rights to the commissioned piece there is an additional fee and we will make a separate secondary contract with them.▷ Clients may not at any time modify, edit or change the Work without permission from the Artist.▷ Any Work done or made available to the client must not be used for AI (Artificial Intelligence, Machine Learning, AI/ML Training, NFT, blockchain or any for profit platforms or purposes. Such usage is completely prohibited and may result in legal action taken.▷ Clients may not claim Work as their own or anyone else’s and therefore must credit us as the Artist using our social tag/username/link (v0id / v0idmochi or SassyBlaze / SassyBlaze_Art).▷ We will not remove the watermark on my art and we ask the Client kindly not to remove it either.▷ Only the Client and/or we are allowed to post the finished commission piece(s)!▷ We require credit to be clearly written in an easy-to-see place. This should be in your Twitter/SNS bio and about page on your channel.

▷ We reserve the right to sign and/or watermark our own work when posted on our Websites and Social Media.▷ You are responsible for protecting your ownership over rights to a character design.▷ We retain all copyright over our work (Art and/or Rig), which includes the right to use the image as a sample for sales or self-promotion unless otherwise agreed upon.▷ We will however always give proper credit to you and the artist for ownership of the character’s design and Artwork rigged, if it is not from us.

Information for Corporate Work

If there are plans to use the model for business purposes (this applies to a company or a talent agency commission), the total price will be adjusted according to the scale of the project.

Severability Clause

If any provision of the present General Terms and Conditions is held to be unenforceable, the enforceability of all remaining provisions shall not be affected thereby.

Place of performance, place of jurisdiction

The parties agree that Hamburg, Germany is the place of jurisdiction and place of performance of their mutual rights and obligations from this contract.
